Commercial law involves two broad areas:
- Drafting agreements
- Dispute resolution (mediation, arbitration and litigation) - see Commercial Litigation
Commercial contracts provide a basis for all commercial activity, particularly written agreements for a range of complex commercial activities such as international trade and transport, joint ventures, partnerships, mining and many other activities.
The drafting of relevant clauses can be important for the operation of commercial contracts, including eg:
- Alternative dispute resolution
- Choice of law
- Force majeure
- Good faith
- Incoterms
- Intellectual property
- International conventions
- Limitation of liability
- Management committees
- Sale of goods
- WTO agreements
