Alternative dispute resolution (ADR) provides for resolution of disputes by arbitration or mediation. There are other less commonly used form of ADR such as expert reference and neutral evaluation. The Federal and State courts have rules providing for reference of disputes to ADR, even if not all parties agree.
Arbitration:
There are two Australian laws governing arbitration.
Domestic arbitrations are governed by uniform arbitration laws in each State and Territory similar to the Commercial Arbitration Act 1984 (NSW).
International arbitrations are governed by the International Arbitration Act 1974 (Cth) which adopts the New York Convention 1958, the Uncitral Model Law 1985 and the ICSID Convention
Mediation:
Mediation is a regular step for consideration in all litigation and is supported by the Rules of Australian Courts.
